What can an Insurance Law attorney do to help me?

An insurance law attorney deals with insurance and insurance carriers and deals with the laws governing the insurance industry. If an insurance company violates principles or regulations governing insurance law and denies a claim that is legitimate, it may constitute a bad faith claim. Some examples of this would be an insurance company delaying making decisions regarding a specific claim or requiring documentation in an unreasonable manner by the insured to prove a claim. Find an insurance attorney in the Internet Lawyer Directory who can help you with an insurance bad faith case.

Insurance Law

The primary goal of insurance is to offer some protection against economic loss that is, as much as one can measure in monetary terms. In other words, insurance obviously can't replace life or take away emotional injury or pain, and can never compensate for loss or the sentimental value of an item or property. In most cases, insurance only limits one's losses anyway.

Having insurance is voluntary in most cases, but when it comes to carrying certain types of insurance, the law will require it. This is the case in auto liability insurance. Since you could injure another person or damage another person's vehicle or property with yours, the insurance requirement exception applies here. Mortgage companies will also require you to purchase homeowner's insurance until your home (mortgage) loan is paid off. You must have an adequate amount of property insurance to cover your deed of trust in the event your home is damaged (lost in a fire, for example). After that time, there is no requirement for a homeowner to have their property insured, though it is always wise to do so.

Insurance law deals with insurance and insurance carriers and deals with the laws governing the insurance industry. If an insurance company violates principles or regulations governing insurance law and denies a claim that is legitimate, it may constitute a bad faith claim. In this instance, an attorney specializing in Insurance Bad Faith Claims could help you. Some examples of this would be an insurance company delaying making decisions regarding a specific claim or requiring documentation in an unreasonable manner by the insured to prove a claim.

Since there is no federal regulatory agency that governs insurance agencies, each state has its own laws that regulate these agencies, usually headed by a state Insurance Commissioner (or other governing official with similar title). State laws are to see that insurance companies conduct business in a manner that is fair and honest toward policyholders. When these laws are violated, the Department of Insurance must step in and see that compliance with state laws are adhered to (by imposing penalties if necessary).

In some cases, a policyholder may feel their insurance company is unfairly denying their claim. When this occurs, because of the complexities of insurance policies and procedures, an attorney experienced in insurance matters should be consulted. Since an insurance policy is a contract between the insurance company and the insured, if the insurance company fails or refuses to pay a claim which should be paid under the terms of the policy, it is considered a breach of contract when the company refuses to pay a policyholder's claim. The insured can then pursue all available legal remedies for the breach of contract. In many cases the insured will be able to recover damages because of this, which at least will equal the amount the insurer should have paid under the terms of the policy.

An insurance law attorney deals specifically with insurance and insurance carriers and is experienced in the laws governing the insurance industry. If an insurance company violates the principles or regulations governing insurance law and denies a claim that is legitimate, it may constitute a bad faith claim.
